Terms of Service
Last updated: October 20, 2026 · United States
Draft. This text still needs to be reviewed by a lawyer (governing law, sales tax and limitation of liability) before it's used with real customers.
These terms are the agreement between Fidelito and the business that signs up for the service in the United States (“the business”). By paying the setup fee or the first period, the business accepts them.
1. Who provides the service
Fidelito, with its address at calle San Antonio número 26, colonia La Gloria, C.P. 29000, Tuxtla Gutiérrez, Chiapas, México. Contact: hola@fidelito.com.mx.
2. What's included
- Digital loyalty cards for Apple Wallet and Google Wallet: all 5 card types (stamp card, cashback wallet, VIP club, prepaid packages and VIP + wallet), unlimited customers and the scanner on your team's phones.
- The owner dashboard with the summary, customers, cards, team and up to 4 promotions a month.
Google and Apple decide how cards and notifications appear on each phone; Fidelito can't guarantee features that depend on them.
3. Pricing
In US dollars, as published at fidelito.com.mx/us on the day you sign up: $29 per month for the first location and $15 for each additional location or card design; one-time setup of $49 (free on the yearly plan). Prices don't include sales tax, which may be added where it applies. Fidelito may change its prices with at least 30 days' notice.
Pending: confirm with an accountant in which states sales tax must be collected and how (e.g. Stripe Tax).
4. Payment
By card, through Stripe, charged automatically every month or every year. Each payment covers the service through the date shown in your dashboard, under “My plan”.
5. Monthly plan
No long-term contract: the business can cancel anytime from its dashboard and the service continues through the last paid day. Amounts already paid (including setup) aren't refunded.
6. Yearly plan: no cancellation or refund
The business pays 10 months and gets 12. In exchange for that price, the yearly plan can't be canceled or refunded, in whole or in part.
7. Failed payments and pause
If a charge fails, there's a 7-day grace period. After that, the service is paused (the scanner stops recording and new customers can't join) until it's paid; customers' cards aren't deleted.
8. The business's responsibilities
- Honor the rewards, discounts, balances and packages it offers. Promotions belong to the business.
- Tell its customers how their information is used and comply with the privacy laws that apply to it (see our privacy policy).
- Keep its dashboard and staff passwords safe.
9. End of service
When the service ends, the business has 15 days to request its customer list. After that, its cards are canceled in Apple Wallet and Google Wallet.
10. Limitation of liability and governing law
Pending: define with a lawyer the limitation of liability, the governing law and where disputes are resolved for US businesses.
